Terms of Service

By creating an account or using OakHeart, you agree to these terms. If you do not agree, do not use the app.

1. Medical Disclaimer

OakHeart is NOT:

• A medical device
• A diagnostic tool
• A substitute for professional medical advice
• A healthcare provider
• HIPAA compliant

Nothing in this app — including AI companion responses, education articles, recovery tracker trends, or community posts — constitutes medical advice.

2. Eligibility

You must be at least 18 years old to use OakHeart. By creating an account, you confirm that you meet this age requirement. If we discover that a user is under 18, we will immediately terminate their account and delete all associated data.

3. Your Account

• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information during registration.
• One account per person. Do not share account access.

4. Health Data and Your Responsibility

You may enter health data into OakHeart, including semen analysis results, hormone levels, and treatment information. You acknowledge that:

• This data is self-reported. We do not verify its accuracy.
• You are responsible for your health decisions. OakHeart does not tell you what to do — it helps you understand your situation and track your progress.
• Trends and visualizations are informational. A graph showing improvement does not mean you should change your treatment. Talk to your doctor.
• The AI companion is not a doctor. It is an AI assistant designed to provide emotional support and educational information. It can make mistakes.

5. Acceptable Use

You agree to use OakHeart only for its intended purpose: personal health education, self-tracking, emotional support, and community participation related to male fertility. You must not:

• Use the app for any illegal purpose or in violation of any applicable law
• Attempt to reverse-engineer, decompile, or disassemble the app or its APIs
• Scrape, crawl, or extract data from the app programmatically
• Circumvent security measures including authentication, row-level security, or rate limiting
• Impersonate another user or misrepresent your identity
• Use the AI companion to generate content for commercial redistribution
• Upload malicious content including viruses, malware, or harmful code
• Interfere with or disrupt the app's infrastructure or other users' experience
• Use the app to provide medical advice to other users, even if you are a licensed healthcare professional (the community is for peer support, not clinical guidance)

6. Subscriptions and Payment

• Free trial. Premium and Couples tiers include a 7-day free trial. No credit card required to start.
• Billing. Subscriptions are billed monthly through your app store (Apple App Store or Google Play Store). Billing is managed by the respective platform.
• Cancellation. You can cancel your subscription at any time through your app store settings. Access continues until the end of your current billing period.
• Refunds. Refund policies are governed by Apple and Google's respective policies.
• Price changes. We will notify you at least 30 days before any price increase. You can cancel before the new price takes effect.

7. Community Guidelines

The OakHeart community exists to provide peer support for men navigating infertility. To keep it safe:

You MUST NOT:

• Harass, bully, or demean other users
• Prescribe medications or treatments — you are not a doctor in this context, even if you are one professionally
• Share other people's personal information without consent
• Post spam, advertisements, or promotional content
• Impersonate another user, healthcare provider, or organization
• Post graphic, sexual, or violent content
• Encourage self-harm or discourage someone from seeking professional help
• Discriminate based on race, gender identity, sexual orientation, religion, disability, or any other characteristic

Enforcement

We reserve the right to remove content that violates these guidelines, issue warnings, suspend accounts, or permanently ban users for serious or repeated violations. Moderation decisions are at our discretion and are final.

8. AI Companion

The AI companion is powered by a third-party AI service (Anthropic's Claude). By using it, you acknowledge:

• Responses are generated by AI, not a human.
• The AI may produce inaccurate, incomplete, or inappropriate responses despite our best efforts to prevent this.
• The AI is not a therapist, counselor, or medical professional.
• In moments of crisis, the AI will direct you to professional resources — if you are in immediate danger, call 988 (Suicide & Crisis Lifeline) or your local emergency services.
• Your conversations are stored and processed as described in our Privacy Policy.

9. Intellectual Property

• Our content. Education articles, conversation guides, app design, and branding are owned by OakHeart. You may not reproduce, distribute, or create derivative works from our content without permission.
• Your content. You retain ownership of content you create (journal entries, community posts). By posting to the community, you grant us a non-exclusive license to display that content within the app.
• AI-generated content. Responses from the AI companion are generated for your personal use and should not be republished as medical or professional advice.

10. Account Termination

By You

You can delete your account at any time from Settings. Deletion is immediate, permanent, and irreversible. All data is removed via cascading delete.

By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Violate Community Guidelines
• Use the app for any illegal purpose
• Attempt to reverse-engineer, scrape, or abuse the app or its APIs
• Engage in behavior that threatens the safety of other users

We will make reasonable efforts to notify you before termination unless doing so would compromise safety or legal compliance. Upon termination by us, you may request export of your personal data within 30 days by contacting cpearsonjr96@gmail.com.

12. Indemnification

You agree to indemnify and hold harmless OakHeart, its creators, and its affiliates from any claims, damages, or expenses arising from your use of the app, your violation of these terms, or your violation of any third party's rights.

13. Dispute Resolution

• Informal resolution first. If you have a dispute, contact us at cpearsonjr96@gmail.com. We will try to resolve it within 30 days.
• Binding arbitration. If informal resolution fails, disputes will be resolved through binding arbitration administered under the rules of the American Arbitration Association. Arbitration will be conducted individually — class actions and class arbitrations are not permitted.
• Exceptions. Either party may seek injunctive relief in court for intellectual property disputes or violations that cause irreparable harm.

14. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. For users in the European Economic Area, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence.

15. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes via in-app notification or email. Continued use after changes constitutes acceptance. If you disagree with updated terms, your remedy is to delete your account.

16. Severability

If any provision of these terms is found unenforceable, the remaining provisions remain in full effect.
